Green Card EB1 Outstanding Researchers and Professors
This category is reserved for Professors and Researchers who have garnered international recognition for outstanding achievements in a particular academic field. The two step green card process is a great way to gain stability and career advancement in the United States.
Eligibility Requirements to Document Outstanding Achievements
A U.S. employer may sponsor an applicant as a Professor or Outstanding Researcher when the following criteria are met:
The applicant must meet at least two of the following via extensive evidence to establish an international reputation:
Receipt of major prizes or awards for outstanding achievement in the academic field
Membership in associations in the academic field that demand outstanding achievement for members
Published material in professional publications written by others about the alien’s work in the academic field. This must include title, date and author of the material and necessary translation
Evidence of the alien’s participation, either on a panel or individually, as the judge of the work of others in the same or allied academic field
Evidence of the alien’s original scientific or scholarly research contributions to the field (original research alone is not enough, it must have contributed to the field)
Authorship of scholarly articles (in scholarly journals with international circulation) or books in the academic field
Separate from point #1, the professor or researcher must be recognized internationally as outstanding in their academic field based on all submitted evidence and show that the applicant’s achievements have been recognized in the field of expertise. Simply presenting evidence listed in #1 does not guarantee approval.
The applicant must have at least three years of experience in teaching and/or research in the academic field.
Experience in teaching or research while working on an advanced degree is acceptable:
if the person obtained the degree and
either had full responsibility for class taught or
if the research conducted toward the degree has been recognized within the academic field as outstanding.
The applicant must have an offer of full time employment from a prospective United States employer. The offer of employment shall be in the form of a letter from:
A private employer offering the alien a permanent research position in the alien's academic field. The contract must confirm that the company employs at least three persons full-time in research positions and that the applicant will work with this team in the research position offered. “Permanent” employment is for a term of indefinite or unlimited duration.
A United States university or institution of higher learning offering the alien a tenured or tenure-track teaching/research position in the alien's academic field
Sponsoring company must demonstrate employment of “at least three persons full-time in research activities.” The additional persons need not be of the same outstanding caliber as the beneficiary, as long as they are engaged in full-time research in the beneficiary’s field.
The employer’s entire research team must be working toward a common goal and prove that the research program as a whole has already achieved documented accomplishments in an academic field.
